Terms and  Conditions for Galeria Furniture
Accessing Any of the Pages on This Website Implies That You agree to the Following Terms
and Conditions of Use to This Website, email, mailer, invoice or other forms of communication.
We may periodically change the terms and conditions of use of this website without notice,
kindly check them from time to time as your continued use of the site signifies your acceptance
of any changed terms.  These terms and conditions apply to every offer and every agreement
between Galeria Furniture herein referred to as Galeria and a buyer to whom Galeria Furniture
has declared these terms and conditions to be applicable insofar as the parties have not
expressly provided otherwise in writing.

Acceptance

When you buy goods from us, you agree to and accept all our terms and conditions.

Indemnification: You agree to defend, indemnify and
hold Galeria harmless from and against any and all claims, damages, costs and expenses,
including direct, indirect, special or consequential damages, attorney’s fees, arising from or
related to your use of the site or our stores. Apart from the provisions of sections 43(5) and
43(6) of the Electronic Communications and Transactions Act, neither Galeria nor any of its
agents or representatives shall be liable for any damage, loss or liability of whatsoever nature
arising from the use or inability to use this website or the services or content provided from and
through this website and our stores. Galeria or its agents shall in no way be held responsible for
any errors or misstatements emanating from this website including prices.

Products and prices
displayed on this site may vary from time to time and are subject to availability and subject to
change. If an item’s correct price is higher or lower than our stated price, we will, at our
discretion, either contact you for instructions before shipping or cancel your order and notify you
of such cancellation.

Risk of loss: Customers who elect to collect from the premises of Galeria
unconditionally agree and accept that the risk of loss and title for such items passes to you at
the time of collection by you or your appointed agent. Galeria will not in any way be liable for damage that may
occur after the products have been handed to the customer or person collecting on behalf of the
customer or during the loading and conveyance thereof. It’s the customer’s responsibility to
ensure that the goods are adequately wrapped and a suitable collection vehicle is utilized in
order to accommodate the size or nature of the product in an upright position and that it is
loaded and secure to prevent damage. The customer may inspect any items at the warehouse
or store. 

Delivery policy: The estimated delivery lead time quoted to you at the time of order is
an at best estimate of the delivery period. We strive to deliver on the date and time advised.
While we are committed to deliver on time, the actual delivery date is subject to prevailing
circumstances and may be subject to variation. Delivery charges are sometimes subject to
changes due to unforeseen circumstances like fuel levy’s or areas outside of our designated
zones, especially as we also use 3rd party delivery companies, Galeria will update clients
accordingly. Galeria shall not be responsible for any damage whatsoever whether direct or
consequential rising out of the use of the goods or in respect of any late or short delivery.


Return policy: All merchandise displayed and sold by Galeria is subject to strict quality control
standards. Should a product be faulty, the customer must notify Galeria within 2 days of
receiving the item and Galeria will endeavor to repair the item in question. Clients may not
return items on the basis that new or latest item prices are lower than when they were
previously purchased. Galeria reserves the right to at any time sell items for lower prices than
they were sold for previously.  Handling fees of 10% of the retail purchase price is charged on refunds to cover our costs.

Sales order terms and conditions: Ownership of the goods will
rest with Galeria until payment has been received in full where after an invoice will be
issued. Payment of the full value of the order is required to reflect in our account, before Galeria will deliver or before we
can authorize collection.

Deliveries will be supplied by Galeria or third party subject to your
address being within our designated delivery zones and you will be charged accordingly on your
invoice. Deliveries will be available from Monday to Friday or weekends by special arrangement,
subject to management’s authorization. Customers who elect to collect from Galeria’s premises
unconditionally agree and accept that the risk of loss and title for such items passes to you at
the time of collection by you or your appointed agent. We strongly encourage customers to
check their order before accepting and signing for it.  For deliveries outside our designated zones, you will be contacted by our staff to confirm delivery price and delivery instruction. For collection of goods from the
Galeria warehouses, prior arrangement and acknowledgement is essential prior to such
collection. Please note that no goods will be given to outside transporters unless
Galeria has been paid in full for such goods. Payments need to be cleared and reflected in our
account. In the event of outside contractors collecting on behalf of a customer, Galeria may in
addition to proof of payment in full, contact the customer to confirm proceedings.To ensure a
smooth and timely delivery please make sure that you clear the room(s) in advance where your
new goods are to be located prior to the delivery service arriving. The Customer must remove
all breakable items in the path of the delivery. Galeria delivery crew is not permitted to re-
arrange Customers’ furniture. Galeria delivery crew team will place the goods delivered in the
place of the Customer’s choice. The delivery crew is not permitted to uplift or take away with
them any unwanted items of furniture or items not designated for removal previously with the
sales team. It is in the customers’ own interests that all loose items of value be removed from
the delivery site and that in addition pets be secured in a safe location away from the crew and
delivery site. Galeria cannot be held responsible for any items claimed to be missing following a
delivery. Breakables such as glasses, vases, wall mountings etc must be secured or
removed from the delivery site. Galeria cannot be held responsible for any items claimed to be
missing or damaged following a delivery.

Delivery policy for flats and small apartments: The maximum sofa length that can be fitted into an elevator cannot exceed 2.1m. If the flat or
apartment does not have a suitable lift for the furniture, then the Galeria delivery team
will only be allowed to carry the items up to 1st floor in height, providing the passages are wide
enough to accommodate the items without any damages to the goods. Galeria delivery teams
will not hoist goods over balconies or walls. Galeria shall not be responsible for any damage
whatsoever whether direct or consequential rising out of the use of the goods or in respect of
any late or short delivery. Galeria furnishes with its goods, its standard guarantees only and no
other guarantees, namely of 6 months, limited to factory faults and warranties or representations
of whatsoever nature will be made to the Customer by Galeria in respect of such goods.


Deposits and cancellations: Orders placed are irrevocable once a deposit has been paid. All
overseas “special orders” placed cannot be reversed once a deposit has been paid. The
customer is liable for the full price of the goods ordered from the factory. 50% deposit is required
to order items from suppliers. Galeria reserves the right to apply a cancellation fee of 5% on
certain lay-by's and up to 10% calculated on the full price of the item in question. Galeria reserves the right to charge a handling fee for returns of any kind to cover our costs. This handling fee would be charged at 10% of the purchase price excluding delivery charges.

DUE TO RISING PRICES FROM SUPPLIERS, AND WAREHOUSE STORAGE DIFFICULTIES, LAYBYE PERIODS ARE
4 MONTHS. AN EXTENSION THEREAFTER IS POSSIBLE, SUBJECT TO MANAGEMENT
APPROVAL. If after 30 days of notification by Galeria that your goods are ready for delivery, you
as the customer fail to make final payment, Galeria reserves the right to sell them to defray
expenses. In the event of Galeria agreeing to refund monies paid either prior to or post-delivery
due to by circumstances unrelated to product quality or lead times, and if Galeria agrees to
accept return of any goods, the Customer will be liable for a 10% handling charge calculated on
the purchase price of those goods. The onus of proof of return and proof of purchase rests with
the customer at all times. A minimum 10% deposit is payable in order to reserve an item in
stock, calculated on the quotation value.

Clearance or Sale items are sold voetstoots and
cannot be exchanged or returned. Payments made by EFT (Electronic funds Transfer) can
only be released once funds reflect in our account. Galeria does NOT accept payment by
cheque due to high risk of fraud. Galeria discourages cash payments due to security concerns
and urges our clients to rather deposit cash funds themselves into our account. We do not carry
cash on the premises even for the use of giving change. We do not give cash change.


Warranties: Galeria furnishes its goods with standard guarantees only and no other
guarantees, warranties or representations of whatsoever nature will be made to the Customer
by Galeria in respect of such goods. Warranty and guarantee claims must be accompanied by a
copy of the original invoice. We offer a 6 month limited warranty on all our items (excluding
mattresses) covering factory faults. Proof of purchase (i.e. original invoice) is required for the
warranty to come into effect and will only be valid when the goods are paid in full. The warranty
does not extend to the fabric or, leather, or sound speakers used on upholstery items as it is
subject to wear and tear which is associated with the usage and/or treatment in the customers
environment and this is beyond the manufacturers control.

Warranty falls away if goods are serviced or repaired or reupholstered in any way by an outside company or individual other than Galeria and its factories.

Warranty claims must be accompanied by a copy of the original sales invoice, and 
proof of delivery. 

Colours: The colours of our products shown on this website may look different on your computer, tablet or phone compared
with the colour of the actual product. For this reason it is strongly recommended that you visit
one of our showrooms or fabric/leather suppliers to see the actual colour of the item. GALERIA cannot be held
responsible for any mistakes in ordering items whose actual colour is different from that
appearing on the website as viewed on your computer.

LEATHER: Leather is not covered under
warranty as we cannot be held liable for how a client looks after, cleans or treats their leather
items. Natural leathers are soft and velvety. They have been tanned without altering any of their
natural features. Therefore, all the distinctive original markings stand out. This is the living proof
of the leather’s absolute natural origins. The following may occur in leather products: Dye lots
may vary, Colour variations may occur due to the multiple hides required to make up the
product, Marks, tick bites, healed scars, scratches, stretch marks and scuff marks are
characteristic of full grain leather and are therefore not defects. Prominent brand marks may
also be visible and are not considered defects. TIMBER: Timber has natural marks and
variations and cannot be seen as defects or signs of damage. FABRICS: It is important to note
that pilling is not a fabric defect or fault and is not covered under warranty. The warranty does
not cover sofa feet or legs only the frame and stitching. MANUFACTURING FLAWS: It happens that during the process of manufacturing there may be marks or variations in upholstery, wood, frames, or other parts, when those parts are hidden they are not considered to be manufacturing flaws or defects of any sort. Hence Galeria and its representatives cannot be held liable for such faults as it is a natural occurrence when manufacturing , for example sometimes placement of hinges or holes need to be changed, if those areas are hidden meaning within the product, or behind the product or inside a cupboard, or in between two joined sofa pieces then they are not considered flaws or defects and cannot be held as such, but rather natural process of the manufacturing of items. 

Custom Made Furniture: Custom made items are non-refundable. Should a client be unhappy with the quality or work they can contact Galeria within 2 days of having receipt of the item with proof of purchase ( Galeria original invoice) and proof of delivery attached. Galeria will endeavour to repair the item should they deem it fair and not damage caused by the client, by their delivery partner or should it fall under manufacturing flaws on hidden areas. It is on the client to return the item at their cost, properly wrapped and delivered to the Galeria factory address provided. Delivery charges are not included and clients must pay for the collection and delivery of the item again. Deposits of 70% are required upfront and balances are payable before delivery. Lead times vary between 2-6 weeks and we cannot be held liable for any
delays. All items sold are for domestic, interior use typical conditions only. GALERIA  furnishes its goods with standard guarantees only and no other guarantees, warranties or representations of whatsoever nature will be made to the Customer by
GALERIA in respect of such goods. Orders placed are irrevocable once a deposit has been paid. In the event of GALERIA

to product quality or lead times, the Customer will be liable for a 10% handling charge calculated on the purchase price of those goods (Excludes services such as delivery). The onus of proof of return and proof of

Clients who want to customize or change our designs to an adaption of their own, do so at their own risk and we cannot be held liable should you decide you don’t like the design with your changes whether it’s the material used, stitching or structural changes. We cannot issue refunds or exchanges or take the item back to redo in these instances.

Clean and care of items: Please request shop advice before undertaking any cleaning and care of items as we
cannot be held liable for damages to fabrics and leather after goods have left our store.

Site Policies, Modification and Severability: Please review any other policies posted on this site. These policies also govern your visit to GALERIA. We reserve the right to make changes to our site, policies, and these Conditions of Use at
any time. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.
